1. Parties
These terms govern the relationship between Grandioso Yachting S.L. (trading as KOSMOS, “we”, “us”) and any person (“Client”) who books or enquires about our services. By confirming a booking you agree to these terms in full.
2. Services
We offer the following services aboard the KOSMOS catamaran:
- Private Charters — day and multi-day bespoke sailing itineraries.
- Offshore Mile Building — skippered offshore passages for RYA qualification candidates.
- Sailing Coaching — one-on-one instruction from beginner to advanced level.
- Liveaboard Accommodation — overnight stays aboard in a marina berth.
3. Booking & Payment
A booking is confirmed only upon receipt of a deposit of 50% of the agreed total (or full payment where agreed in writing). The remaining balance is due no later than 7 days before the departure date. Failure to pay the balance by this date may result in cancellation and forfeiture of the deposit.
Payments may be made by bank transfer (SEPA) or another method agreed in writing. All prices are in Euros and include Spanish IVA where applicable.
4. Cancellation by the Client
Cancellations must be made in writing to info@kosmossailing.com. The following policy applies:
- More than 30 days before departure — deposit refunded less a 15% administration fee.
- 15–30 days before departure — 50% of the total booking value refunded.
- Fewer than 15 days before departure — no refund. The full amount is forfeit.
We strongly recommend purchasing travel insurance with cancellation cover.
5. Cancellation or Modification by KOSMOS
We reserve the right to cancel or modify a booking in the following circumstances:
- Adverse weather or sea conditions that, in the skipper's sole judgement, make the planned activity unsafe.
- Mechanical failure or unforeseen vessel maintenance requirements.
- Force majeure events (see clause 8).
Where we cancel, we will offer a full refund or a rescheduled date at your choice. We are not liable for consequential losses (travel, accommodation, etc.) arising from our cancellation.
6. Safety & Conduct
The skipper has ultimate authority over the vessel and all decisions affecting safety. Clients must follow all instructions from the skipper and crew. We reserve the right to refuse participation or terminate a booking without refund where a client's behaviour or condition poses a risk to others or to the vessel.
All participants must:
- Disclose any medical conditions, disabilities, or medication that may affect their safety or participation, at the time of booking.
- Be at least 18 years of age, or be accompanied by a responsible adult who accepts liability for the minor.
- Wear a life jacket when required by the skipper.
7. Liability
KOSMOS maintains valid marine insurance covering third-party liability and the vessel. We accept no liability for:
- Loss of or damage to personal belongings brought aboard.
- Personal injury arising from failure to follow safety instructions.
- Indirect, consequential, or economic losses of any kind.
Nothing in these terms limits our liability for death or personal injury caused by our negligence, or for any liability that cannot be excluded by law.
8. Force Majeure
We are not liable for failure to perform where that failure results from circumstances beyond our reasonable control, including but not limited to: extreme weather, natural disasters, acts of government, port or marina closures, civil unrest, or pandemic-related restrictions. In such cases we will offer a reschedule or, where rescheduling is not possible, a full refund.
9. Mile Building & Coaching
Participation in mile building passages and coaching sessions involves inherent maritime risks. Clients participate voluntarily and acknowledge these risks. Logbook miles are certified by our RYA instructor subject to satisfactory participation; we cannot guarantee specific outcomes or examination results.
10. Governing Law & Disputes
These terms are governed by the laws of Spain. Any dispute that cannot be resolved amicably shall be subject to the exclusive jurisdiction of the courts of Algeciras, Cádiz.
